1. Seller and Basic Identification

The seller is a payer of value added tax (VAT). All prices listed in the e-shop are final prices including VAT.


2. Introductory Provisions

These terms and conditions (hereinafter referred to as "conditions") regulate the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase agreement concluded between the seller and the buyer through the online store.

For the purposes of these conditions, a buyer means a natural or legal person who concludes a purchase agreement with the seller through the e-shop. A consumer is a buyer who is a natural person and acts outside the scope of their business activity.

Deviating arrangements in the purchase agreement take precedence over the provisions of these conditions.


3. Conclusion of the Purchase Agreement

All presentation of goods placed in the e-shop catalog is for informational purposes only, and the seller is not obliged to conclude a purchase agreement regarding these goods.

The buyer places an order for goods by selecting the product, adding it to the cart, and filling out the order form. Before submitting the order, the buyer has the opportunity to check and change the entered data.

By submitting the order, the buyer confirms that they have read these terms and conditions and agree to them.

The purchase agreement is concluded upon delivery of the order confirmation by the seller to the buyer's e-mail address.

The buyer agrees to the use of remote communication means for concluding the purchase agreement. The costs incurred by the buyer for using remote communication means (internet connection) are borne by the buyer.


4. Price of Goods and Payment Terms

The prices of goods include VAT. The seller is a VAT payer.

Current prices of goods and any special offers are listed on the e-shop pages. The seller reserves the right to change prices.

The buyer is obliged to pay the price of the goods using the chosen payment method:

  • Online card payment – payment is processed through a secure payment gateway. The order is processed after payment is received.

The seller will issue a tax document – an invoice – to the buyer and send it in electronic form to the buyer's e-mail address.


5. Delivery of Goods

The seller undertakes to dispatch the goods within 5 working days from order confirmation (or from payment receipt).

Goods are delivered to the address provided by the buyer in the order within the Czech Republic. The delivery method and current shipping cost are always displayed in the cart before completing the order.

Upon receipt of the shipment, the buyer is obliged to check the integrity of the packaging. Any damage must be reported immediately to the carrier and the seller.


6. Withdrawal from the Contract

6.1 Consumer's Right of Withdrawal

The consumer has the right to withdraw from the purchase agreement without giving a reason within 14 days from the day of receiving the goods (§ 1829, paragraph 1 of Act No. 89/2012 Coll., Civil Code).

The consumer acknowledges that, according to § 1837 letter d) of the Civil Code, it is not possible to withdraw from a contract for the delivery of goods that have been modified according to the buyer's wishes or for their person, and according to § 1837 letter e), it is not possible to withdraw from a contract for the delivery of goods in sealed packaging which the consumer has removed from the packaging and which cannot be returned for hygienic reasons.

Unopened goods (coffee in undamaged original packaging) can be returned within 14 days of receipt.

6.2 Procedure for Withdrawal

Withdrawal must be sent to the e-mail address ordine@beacaffe.cz or by post to the seller's registered office address within 14 days. The buyer must state the order number, a description of the goods, and the bank account number for refunding the payment.

The buyer shall send the goods back at their own expense without undue delay, no later than 14 days from withdrawal. The goods must be undamaged and in their original packaging.

The seller will refund all received payments to the buyer (including standard shipping costs) within 14 days of withdrawal, but no later than upon receipt of the returned goods or proof of their dispatch.

The refund will be made using the same method as the payment was received, unless the parties agree otherwise.


7. Rights from Defective Performance and Complaints

The seller is responsible to the buyer for ensuring that the goods are free of defects upon receipt. The rights and obligations of the contracting parties regarding rights from defective performance are governed by the relevant provisions of the Civil Code (especially §§ 2099–2117).

The consumer has the right to file a complaint with the seller within 24 months of receiving the goods.

For food products (coffee), rights arising from defective performance are applied in accordance with the law – especially in cases where the product is visibly damaged upon receipt, does not meet the declared properties, or the minimum shelf life has expired before dispatch.

Complaints can be made by e-mail to ordine@beacaffe.cz or by phone at +420 777 841 353. The seller will handle the complaint without undue delay, no later than 30 days from the date it was filed.


8. Personal Data Protection

The seller processes the buyer's personal data for the purpose of fulfilling the purchase agreement, maintaining accounting records, and fulfilling legal obligations. Detailed information on the processing of personal data is available in the Privacy Policy on the e-shop's website.

The seller complies with obligations arising from the GDPR (EU Regulation 2016/679) and relevant Czech legal regulations.


9. Out-of-Court Dispute Resolution

In the event of a dispute between the seller and the consumer that cannot be resolved by agreement, the consumer has the right to out-of-court dispute resolution through the Czech Trade Inspection Authority (ČOI).

The consumer can also use the EU online dispute resolution platform available at: https://ec.europa.eu/consumers/odr

This option for out-of-court dispute resolution is offered in accordance with § 20d et seq. of Act No. 634/1992 Coll., on consumer protection.


10. Final Provisions

These terms and conditions are valid and effective from the date of their publication on the e-shop's website. The seller reserves the right to change the conditions; the new conditions are effective from the moment of their publication.

Relations not regulated by these conditions are governed by the legal order of the Czech Republic, especially Act No. 89/2012 Coll. (Civil Code) and Act No. 634/1992 Coll. (Consumer Protection Act).

The seller is authorized to sell goods based on a trade license.

 

These terms and conditions become effective on April 1, 2026.
